Basic Information

1. Why was the Notice issued?

The Supreme Court of the State of New York, Nassau County, authorized the Notice. The Class Members have a right to know about the proposed Settlement of this class action lawsuit, and about all the options, before the Court decides whether to grant final approval of the Settlement. The Notice explains the lawsuit, the class members legal rights, what benefits are available, and who can receive them.

The lawsuit is called Peter Lazar and Sheba Khan v. International Shoppes, LLC and Diplomatic Duty Free Shops of New York, Inc., Index No. 623891/2025. It is pending in the Supreme Court of the State of New York, Nassau County. The people that filed this lawsuit are called the “Plaintiffs” (or “Class Representatives”) and the companies they sued, International Shoppes, LLC and Diplomatic Duty Free Shops of New York, Inc., are called the “Defendants.”

2. What is this lawsuit about?

This lawsuit alleges that during the November 2023 cyberattack on International Shoppes' computer systems, certain files that contained personal information were accessed. These files may have contained personal information such as Information that identifies an individual or that in combination with other information can be used to identify, locate, or contact an individual.

3. What is a class action?

In a class action, one or more individuals sue on behalf of other people with similar claims. These individuals are called the “Plaintiffs” or “Class Representatives.” Together, the people included in the class action are called a “Class” or “Class Members.” One court resolves the lawsuit for all Class Members, except for those who opt out from the Settlement. In this Settlement, the Class Representatives are Peter Lazar and Sheba Khan. Everyone included in this Action are the Class Members.

4. Why is there a settlement?

The Court did not decide whether the Plaintiffs or the Defendants are right. Both sides have agreed to a settlement to avoid the costs and risks of continued litigation, and to allow the Class Members to receive benefits from the Settlement. The Plaintiffs and their attorney think the Settlement is best for all Class Members.

5. Who is included in the Settlement?

For settlement purposes, the Court has defined the Class this way: “All individuals residing in the United States whose Personal Information was compromised in the Data Incident discovered by Defendants in December 2023, including all those individuals who received notice of the Data Incident.”

6. Are there exceptions to being included?

Yes. Excluded from the Class are: (1) the Judge in this case, and the Judge’s family and staff; (2) International Shoppes and its officers, directors, and related companies; and (3) anyone who validly excludes themselves from the Settlement.

7. What does the Settlement Provide?

International Shoppes has agreed to pay for a number of different benefits. All Class Members may claim Credit Monitoring Services and one of two Payment options.

Credit Monitoring Services. All Class Members are eligible to enroll in two years of CyEx Financial Shield Complete. This comprehensive service comes with $1 million of financial fraud insurance, and includes monitoring for:

  • fraud or identity theft

  • unauthorized financial transactions

  • high-risk financial transactions

If anything suspicious happens, Class Members will be able to talk to a fraud resolution agent to help fix any problems.

Payment Options

Out-of-Pocket Losses. If a Class Member incurred actual, documented out-of-pocket losses due to the Data Incident, the Class Member can get back up to $4,000.00. The losses must have occurred between November 16, 2023, and November 11, 2026.

This benefit covers out-of-pocket expenses like:

  • losses because of identity theft or fraud

  • fees for credit reports, credit monitoring, or freezing and unfreezing your credit

  • cost to replace your IDs

  • postage to contact banks by mail

The Class Member needs to send proof, like bank statements or receipts, to show how much there spent or lost. Class Members can also send notes or papers they made themselves to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Class Members proof or notes should show that their expenses were because of the Data Incident.

A Class Member cannot claim a payment for expenses that have already been reimbursed by a third party.

-OR-

Alternative Cash Payment. Instead of the benefits in Out-of-Pocket Losses, Class Members may claim a one-time cash payment. This payment is expected to be $50.00, but may be smaller depending on the total claims filed.

There is an aggregate cap of $500,000.00 on these benefits. This means that if the total value of benefits claimed is over $500,000.00, everyone’s payments will be reduced pro rata so that they add up to $500,000.00. A full description of how this works is available in the Settlement Agreement.

8. What claims am I releasing if I stay in the Class?

If Class Members stay in the class, they won’t be able to be part of any other lawsuit against International Shoppes about the issues that this Settlement covers. The “Releases” section of the Settlement Agreement (Section IX) describes the legal claims that you give up if you remain in the Class.

9. How do I submit a claim for a Settlement benefit?

10. Are there any important Settlement deadlines?

If a Class Member is submitting a Claim Form online here, they must do so by November 11, 2026. If they are downloading a Claim Form here and submitting a claim by U.S. mail, the completed and signed Claim Form, including supporting documentation, must be postmarked no later than November 11, 2026.

11. When will the Settlement benefits be issued?

The Court will hold a Final Approval Hearing on November 16, 2026 (see Question 18). If the Court approves the Settlement, there may be appeals. We do not know if appeals will be filed, or how long it will take to resolve them if they are filed.

Settlement payments will be distributed if the Court grants final approval, and after any appeals are resolved.

12. Do I have a lawyer in the case?

Yes, the Court has appointed attorney Cassandra P. Miller of Strauss Borrelli PLLC, to Class Members (“Class Counsel”).

13. Should I get my own lawyer?

Class Members will not be charged for Class Counsel’s services. If a Class Member want their own lawyer, they may hire one at their expense.

14. How will Class Counsel be paid?

Class Counsel will ask the Court to approve up to $165,000.00 as reasonable attorney's fees and costs of litigation. This amount will be paid by International Shoppes. Class Counsel will also ask for Service Award payments of $4,500.00 for each of the two Class Representatives. Those Service Award payments will be paid by International Shoppes.

Excluding Yourself from the Settlement

15. How do I opt out of the Settlement?

If a Class Member does not want to be part of the Settlement, they must formally exclude themself from the Settlement. This is called a Request for Exclusion and is sometimes also called “opting out.” If a Class Member opts out, they will not receive Settlement benefits or payment. However, Class Members will keep any rights they may have to sue International Shoppes on their own about the legal issues in this case. If a Class Member excludes themself, they are telling the Court that they do not want to be part of the Settlement. The Class Member will not be eligible to receive any Settlement benefits if they exclude themselves.

The deadline to exclude yourself from the Settlement is October 12, 2026.

To be valid, a Request for Exclusion must have the following information:

  1. the name of the Litigation: Peter Lazar and Sheba Khan v. International Shoppes, LLC and Diplomatic Duty Free Shops of New York, Inc., Index No. 623891/2025, pending in the Supreme Court of the State of New York, Nassau County;

  2. Class Member’s full name, mailing address, telephone number, and email address;

  3. personal signature;

  4. the words “Request for Exclusion” or a clear and similar statement that you do not want to participate in the Settlement.

The Class Member may only exclude themself—not any other person.

Commenting on or Objecting to the Settlement

16. How do I tell the Court if I like or do not like the Settlement?

If a Class Member does not like part or all of the Settlement, they can object to it. Objecting means telling the Court your reasons for why you think the Court should not approve the Settlement. The Court will consider your views.

A Class Member cannot object if they have excluded themself from the Settlement (see Question 15). A Class Member must provide the following information for the Court to consider their objection:

  1. the name of the Litigation: Peter Lazar and Sheba Khan v. International Shoppes, LLC and Diplomatic Duty Free Shops of New York, Inc., Index No. 623891/2025, pending in the Supreme Court of the State of New York, Nassau County;

  2. Class Member’s full name, mailing address, telephone number, and email address;

  3. a clear description of all the reasons they object; include any legal support, such as documents, they may have for the objection;

  4. whether the objection applies only to you, or to other Class Members, as well;

  5. if a Class Member hired their own lawyer to represent them for this objection, provide their name, bar number, and contact information;

  6. whether or not the Class Member or their lawyer would like to speak at the Final Approval Hearing;

  7. if the Class Member or their lawyer have objected in any other cases, list the names, courts, and civil action numbers for each of those cases;

  8. if a Class Member plans on calling witnesses or submitting documents at the Final Approval Hearing, provide a full list of both;

  9. Class Member’s signature (or, if they have hired their own lawyer, the lawyer’s signature).

For an objection to be valid, it must meet each of these requirements.

To be considered by the Court, the Class Member must file the complete objection with the Clerk of Court by October 12, 2026. Class Members must also send a copy of the objection to the Settlement Administrator, Class Counsel, and counsel for Defendants.

17. What is the difference between objecting and excluding?

Objecting is telling the Court that the Class Member do not like something about the Settlement. The Class Member can object to the Settlement only if they do not exclude themself from the Settlement. Excluding themself from the Settlement is opting out and stating to the Court that they do not want to be part of the Settlement. If a Class Member opts out of the Settlement, they cannot object to it because the Settlement no longer affects them.

The Court’s Final Approval Hearing

18. When is Court’s Final Approval Hearing?

The Court will hold a final approval on November 16, 2026, at 9:30 a.m. Eastern Time, in 3rd Floor Courtroom of the Supreme Court of the State of New York, Nassau County, at 100 Supreme Court Dr, Mineola, NY 11501.

At the Final Approval Hearing, the Court will decide whether to approve the Settlement. The Court will also decide how much Class Counsel should be paid, and whether to award Service Award payments to the Class Representatives. The Court will also consider any objections to the Settlement.

If you are a Class Member, you or your lawyer may ask permission to speak at the hearing at your own cost (see Question 16).

The date and time of this hearing may change without further notice.

19. Do I have to come to the Final Approval Hearing?

No. Class Counsel will answer any questions the Court may have. A Class Member may attend at their own expense if they wish, but they do not have to.

If a Class Member files an objection, they do not have to come to the Final Approval Hearing to talk about it; the Court will consider it as long as it was filed on time. A Class member may also pay their own lawyer to attend, but they do not have to.

If I Do Nothing

20. What happens if I do nothing at all?

If a Class Member does nothing, they will not receive a benefit from this Settlement. They will also give up the rights described in Question 8.
